 The Munich prosecutor accuses the co-head of Deutsche Bank, hinge plates, and several former top manager of the financial institution for attempted fraud in the process Kirch method. The Munich District Court must now decide whether to accept the indictment.

The Co-head of Deutsche Bank, Jürgen Fitschen, has been charged with attempted fraud in the process Kirch method. The Munich prosecutor accuses the 66-year-olds as well as its predecessors Rolf Breuer and Josef Ackermann before inaccurate testimony. Also, another former board and former chairman of the board Clemens Börsig were accused by the prosecution, as a court spokeswoman confirmed.

The prosecution assumes that managers with misstatement payment of compensation to the heirs of the deceased in court wanted to prevent media entrepreneur Leo Kirch. Since the bank in the end paid, it’s all about trying to process fraud. The defendants had always denied the allegations. The German bank pointed to earlier statements on request, after which it is convinced that the suspicions against Jürgen Fitschen will prove to be unfounded.

Fitschen leads the German bank since June 2012 together with Anshu Jain and is considered one of the most important business leaders in Germany. After the filing of the action, the district court in Munich has to decide whether this is allowed and it thus comes to the process in the next step. The decision could still take months. A process would not be starting before next year.



Ecclestone judge responsible

As defendant Fitschen, Ackermann, Breuer and the other parties would have to personally appear in court. Responsible for the case is the 5th Criminal Chamber to the presiding judge Peter Noll, who had set the bribery trial of Formula 1 boss Bernie Ecclestone on payment of a record sum of $ 100 million in August.

This method is the last open construction site of the Deutsche Bank in a dispute with the church-heirs. Leo Kirch and later his heirs made the bench for the collapse of the Kirch media empire in 2002, responsible and covered the house with money processes. Before the Higher Regional Court (OLG) Munich, the heirs had success. After a long inquiry condemned the OLG the bank shortly before Christmas 2012 in damages.

In February 2014 finally closed both sides of a comparison. Against payment of approximately 925 million euros, the bank agreed with the Kirch-heirs to an amicable end to the feud. The investigation by the public prosecutor against the manager but went further still.
